就職活動から始まり、就職後の労働条件、退職に至るまでを、労働法規を通してそのルールを学ぶ。法制度の趣旨、内容とともに、近年の就業形態の多様化、労使関係の安定化、景気動向など雇用関係を取り巻く変化に応じて労働法がどのように発展、修正されてきたのかなどを理解し、労働法を法令に沿って理解・解釈できることを達成目標としている。

Starting with seeking employment and working conditions after employment, to termination of employment, students will learn about regulations by looking at labor laws. The objectives of this course is to achieve an understanding of how labor laws develop and are changed according to the purports of the legal system and its content, and how they are influenced by changes in employment relationships such as diversification in forms of employment, the stabilization of labor-management relations and economic trends.

労働・雇用に係わる法律・制度について概観する。講義形式で授業を行う。学生に労働法を身近に感じてもらうために、授業内で視聴するVTRや新聞記事を元にしたディスカッション・レポート作成を指示することがある。

Students will get an overview of the laws and systems of labor and employment. This will be a discussion-based course. In order for students to understand how closely labor laws relate to them, discussion reports on videos shown in class and newspaper articles may be assigned.

2. Significance of Labor Laws (What is a labor law? Understand its structure.)
3. Seeking Employment and Labor Laws (Learn about recruitment, employment, offer of employment and probationary period.)
4. Employment Regulations and Workplace Regulations (Learn about Labor Contracts and Employment Regulations)
5. Wages (Learn about wages, benefits, bonuses, severance pay and other wage related regulations.)
6. Working Hours, Breaks, Holidays, Vacation (Learn about working hours and breaks, holidays, annual leave, etc.)
7. Active Learning (Working hours, Overtime, Overtime pay) Watching a video on overtime work and write a report to be submitted at the 8th week’s lecture.
8. Basic Labor Laws (Learn about protection under basic labor laws.)
9. Active Learning (Collective bargaining, Unfair labor practices) Watch a video on unfair labor practice investigations of collective bargaining refusals and write a report to be submitted at the 10th week’s lecture.
10. Transfer of Personnel (Learn about the reassignment, secondment, transfer.)
11. Labor Contract Termination (Learn about retirement, termination of employment, dismissal, termination of contract.)
12. Diverse Forms of Employment (Learn about part-time workers, contract workers, dispatch workers.)
13. Equal Employment Opportunity Law, Child Care and Family Care Leave Law (Learn about gender equality and work-life balance.)
14. Labor Insurance and Summary (Learn about employment insurance and workers' compensation insurance.)
15. Final Exam (written exam)

評価方法：学期末試験の成績（80%)、アクティブラーニングのレポート及びコメントシート（20％）によって評価する。
学年末試験の評価基準：労働法令の的確な理解と解釈を問う論述式の問題であり、評価基準は、法令を適切に解釈して論理的に記述し十分な解答ができるか。
アクティブラーニング及びコメントシートの評価基準：題材となるVTRに加えて、主体的に法令や判例を調べて、適切に論ずることができるか。

A comprehensive evaluation based upon the results of the final exam (80%) and class participation (comment papers, reports, etc.; 20%).
|

|
事前学習：あらかじめテキストを熟読して予習し、疑問点を授業中に質問できるよう準備しておく。なお、テキストは欄外の注にも注目すること。日頃から労働法、労働政策、雇用政策に関する新聞記事、雑誌、テレビ報道等に興味を持つこと。
事後学習：教員の指示に従い、配付資料、参考書等を利用しながら、授業後の復習を行うこと。

Pre-read texts and come to classes prepared. Do not limit studies to the text. Take a daily interest in newspaper articles, magazines and television programs on labor laws, labor systems and employment policies.

テキストを購入のうえ、必ず持参して受講のこと。授業計画は法改正の動向によって変更されることがある。授業内で配布したプリントは、欠席者などに再配布はしないので、毎回出席のこと。

Purchase and bring it to each class. Course plans may change due to the direction of legal reforms. Students must attend classes each week as handouts distributed in class will not be provided to those who are absent.
