歴史的法学的にいかに日本人は統制されてきたのか。諸外国との比較を交えつつ、現代日本社会における国籍・戸籍問題を通して考慮していきたい。

How has regulation impacted on the Japanese historically and legally? We will consider issues in contemporary Japanese society related to nationality and the family registry in international comparison.

日本人であるということは、法的にどのようなことか。国籍と戸籍の関係性に注目しつつ、 戸籍または国籍がないということが具体的に何を意味するのか、さらに法的ステータスを得るための条件等を通して、日本の法制度における日本人の画定、さらに法的アイデンティティの形成を分析したい。その根本にある家族という枠組み、さらにそのモデルを形作っていく多様な過程にも注目する。

What does it legally mean to be Japanese? Focussing on the relation between nationality and the family register, we will analyse what it means to have neither, the conditions for obtaining legal status, the demarcations of Japaneseness in the Japanese legal system, and the formation of legal identity. We will also pay attention to the family as the basis, as well as the various processes shaping this model.

Day 4 訴訟を通してみる国籍と戸籍 Session 1 国籍訴訟 Session 2 戸籍と非嫡出子問題 Session 3 憲法平等原則、外国人の人権の意味するところ Question 具体的な事案から憲法の人権と戸籍法・国籍法の関係について考える。

The link between the family register and nationality. The location within foreign systems. An analysis of international marriages.
Day 3: Statelessness and 'family register-lessness' Session 1: Statelessness and international law Session 2: The problem of statelessness Session 3: The establishment of legal identity Questions: What does it mean to not exist legally? The possibility of establishing a legal identity.
Day 4: Family register and nationality via litigation Session 1: Nationality litigation Session 2: The family register and the problem of illegitimate children Session 3: Constitutional equality principle. Foreigners and the meaning of human rights Question: Thinking about the relationship between constitutional human rights, the registry system, and nationality law through specific case studies.
Day 5: Session 1: The change of the family model (through reproductive technology) 1 Session 2: The change of the family model (thought same-sex marriage) 2 Session 3: The future of parent-child relationships Question: Thinking about the future of the family model underscoring the idea of the nationality and the family registry.
